It is free to join Select Law. Simply complete our online registration form. Select Law will then send your firm an invitation to tender for matters suited to your practice (i.e. according to geographical area, practice areas and language) after which you can submit tenders for free.

General terms and conditions

1. Definitions

1.1“Select Law” used in these terms and conditions, and throughout the Website, means Select Law Pty Ltd (ACN 124 185 119) and may be referred to interchangeably as, “We” “Us” and “Our" as appropriate.  It also includes our employees, agents and servants.

1.2 “Firm” refers to law firms, incorporated practices or sole practitioners who are members of Select Law.

1.3 “User” refers to those members of the general public (including companies and in-house counsel) utilizing this Website in order to find a Firm or otherwise.

1.4 “General Terms and Conditions” means these terms and conditions.

1.5 “Referral Fee” means the fee that the Winning Firm must pay to Select Law.

1.6 “Website” means this website, ie, www.selectlaw.com.au.

1.7 “You” and “Your” refer to the User and Firm collectively.

1.8 “Bid", "Tender", "Quotation" and “Quote” are used interchangeably in these General Terms and Conditions, and throughout the rest of the Website, to mean an estimate of legal fees, charge out rate given by a Firm and/or any quotation notes. 

1.9 Use of the singular in these General Terms and Conditions and throughout the Website includes, where appropriate, a reference to the plural.

1.10 “Winning Firm” means the Firm a User chooses as his/her/its preferred law firm on the Website, or the Firm which We deem to be the Winning Firm.

2. Application

2.1 These General Terms and Conditions apply to Users and Firms.

3. Acknowledgement and acceptance of General Terms and conditions

3.1 By accessing, browsing or using the Website You impliedly acknowledge that You have read and understood these General Terms and Conditions and agree to be bound by them.

3.2 By completing the registration process to become a User or Firm You expressly agree to be bound by these General Terms and Conditions.

4. Amendments to General Terms and Conditions

4.1 We may amend these General Terms and Conditions at our discretion, and from time to time.

4.2 Your continued use of the Website after any amendment to the General Terms and Conditions, is taken to constitute Your acceptance of those amended General Terms and Conditions.  It is Your responsibility to check these General Terms and Conditions each time You use the Website.

5. Information service only

5.1 Select Law is an information service only.

5.2 Select Law does provide any advice about Firms, and does not advise Users which Firm may be best for them.

5.3 You acknowledge that Select Law is not and does not represent or hold itself out to be:

a) a law firm, incorporated practice or lawyer;

b) the provider of legal advice; or

c) a party to any relationship that may arise between a User and Firm.

6. Impartial service

6.1 Select Law is an impartial, independent, unbiased information service, and is not sponsored by any law firm, incorporated practice or sole practitioner in Australia or elsewhere.

6.2 We match Firms and Users by considering, but not limited to, the following factors: geographical location, practice areas and language needs.

7. Warranties about Your information

7.1 You warrant to Us that any information You have submitted on the Website:

a) is accurate and not false, misleading, deceptive or fraudulent;

b) does not breach any intellectual property rights of a third party or licence agreement;

c) complies with all applicable laws, government regulations or guidelines;

d) is not forged, threatening, offensive or could constitute harassment;

e) does not contain confidential information or trade secrets unless you have obtained the consent of the owner;

f) does not contain any viruses, worms, Trojan horses or other invidious programs or data, whether attached to or embodied in other programs or data;

g) will not defame (libel or slander) another person or transmit misleading or inaccurate information of any kind, whether of a personal or commercial nature;

h) does not contain any offensive or obscene material; and

i) is Yours in that you are the legal and equitable owner of that information.

8. Content posted by You

8.1 We do not guarantee, warrant or represent that:

a) content posted on the Website by Users or Firms is correct, accurate, of a certain quality or integrity, legitimate or current;

b) trademarks, marks, logos or product names which have been posted on the Website by a User or Firm are the property of that User or Firm or that the User or Firm is legally permitted to post that data; or

c) it is safe to open images or data posted by Firms or Users.

8.2 We reserve the right to delete or amend any information posted by You on the Website, at our total discretion, at any time and without notice.

9. Termination of accounts

9.1 We reserve the right to terminate Your account with Us (whether that be a Firm or User account), any at time, at our absolute discretion and without notice or reason.  Without limitation, examples of when We may terminate Your account include if You:  

a) breach of these General Terms and Conditions or any of the other terms and conditions set out below;

b) Use the Website in a manner detrimental to the reputation or effective operation of Select Law;

c) do not use the Website for genuine purposes (ie, to find a suitable Firm or to win work from Users); or

d) use the Website for ulterior purposes.

10. Protection of copyright, trademarks and content

10.1 We are the full legal and equitable owner of the:

a) copyright in Website, which includes, but is not limited to, all source and object code, images, text, business ideas and plans, compilations, audio recordings and the “look and feel” of the Website;

b) trademarks used in the Website; and

c) Website and all property in and surrounding the Website, including, but not limited to all source and object code, all images, text, business ideas and plans, compilations, audio recordings and the “look” and “feel” of the Website.

10.2 You agree not to sell, copy, publish or reproduce any part of the Website (including, but not limited to, all source and object code, images, text, business ideas and plans, compilations, audio recordings, content posted by Users, Firms or Third parties and the “look and feel” of the Website) unless expressly authorised, in writing, and signed by a director of Select Law.

10.3 You agree not use the Website for your own commercial purposes or reverse engineer the Website or any of its contents.

11. Use Website at own risk

11.1 You understand and accept that We do not warrant, guarantee or represent that:

a) Your posted content or content posted by any User or Firm is 100% secure, free of corruption or bugs or will be successfully transmitted to either Users or Firms;

b) Your posted information will not be lost or accessed unlawfully by Third Parties, Users or Firms; or

c) it is safe for You to use the Website.

11.2 You agree to use the Website and the services offered by Select Law wholly at Your own risk.

11.3 You understand and accept that We are not liable for any data loss or corruption or any other loss or damage that You, or a related party, may suffer by using the Website or our services.

12. Third party advertising

12.1 We make no warranty, guarantee, or representation in relation to Third Party advertisements in the Website.

12.2 We do not endorse any Third Party that advertises on the Website.

12.3 We are not liable for any loss or damage that You may incur in relation to a Third Party advertisement on the Website.

13. Disclaimer as to liability

13.1 You understand and accept that Select Law is not liable (directly or indirectly) for any loss or damage or other detriment that You, or a related party, may suffer by or in connection with:

a) the Website;

b) the services that We provide;

c) Third Party advertisements on the Website or on other Select Law material; and

d) any relationship that may eventuate between a User and Firm, Firm and Firm, or User and User.

14. Indemnification

14.1 You agree to indemnify Us, our employees, agents, owners, directors, contractors and affiliated parties for any liability (including, but not limited to loss, damage, costs, expenses and legal fees) that may arise from or in connection with Your use of the Website, our services, Third Party advertisements and any relationship that may eventuate between a User and Firm, Firm and Firm, or User and User.

1.10 “Winning Firm” means the Firm a User chooses on the Website as the law firm he/she/it would like to meet with to discuss their legal matter, or the Firm which We deem to be the Winning Firm.

1.11 Use of the singular in these User Terms and Conditions and throughout the Website includes, where appropriate, a reference to the plural.

2. Application

2.1 These User Terms and Conditions apply to Users.

3. Acknowledgement and acceptance of User Terms and conditions

3.1 By accessing, browsing or using the Website You impliedly acknowledge that You have read and understood these User Terms and Conditions and agree to be bound by them.

3.2 By completing the registration process to become a User or Firm You expressly agree to be bound by these User Terms and Conditions.

4. Amendments to User Terms and Conditions

4.1 We may amend these User Terms and Conditions at our discretion, without notice and from time to time.

4.2 Your continued use of the Website after any amendment to the User Terms and Conditions, is taken to constitute Your acceptance of those amended User Terms and Conditions.  It is Your responsibility to check these General Terms and Conditions each time You use the Website.

5A. No guarantee we will activate your case

5A.1 We reserve the right not to activate your case ie, not to invite Firms to tender for your matter.

5A.2 In the event that We do not activate your case, that is not a representation by Us that You should not seek legal advice in relation to the case We will not activate.

5. Our use of Your Personal Information

5.1 Our obligations in relation to Our use of User information is set out in our Privacy Policy.

5.2 By registering with Select Law, You agree that some of Your Personal Information will be visible to all Firms that We invite to tender for your matter. You also understand that Your contact details will only be provided to the Winning Firm.

5.3 We may alter the Personal Information You have provided, if, in our opinion, the amendments will help to clarify Your legal problem.  Those amendments may include, but are not limited to, typographical errors, formatting errors or clarification of the legal problem.  You agree to review Your Personal Information including case details after We activate Your case.  You agree to notify Us in writing immediately if any part of You Personal Information (including case details) is incorrect. 

5.4 We may contact You to discuss the Personal Information You have provided and, among other things, to verify that the Personal Information You have posted is genuine and to follow up and obtain feedback.

6. Firm use of Your Personal Information

6.1 By registering with Select Law, Firms have agreed to keep Your Personal Information confidential to the extent permissible by the Law.  You understand that we will provide "matching" Firms with some of Your Personal Information and that Your contact details will only ever be given to the Winning Firm.

6.2 You expressly agree that We are not in any way liable, in law or in equity (directly or indirectly) for any breaches of duty (including breaches of confidentiality or privilege) that Firms may commit.

6.3  You acknowledge that by Us providing Your Personal Information to Firms, it may eventuate that a Firm cannot act for a future client, because to do so, may mean that the Firm would be required to disclose your Personal Information to that new client.  You release Us from all liability that may arise from or in connection with Our provision of Your Personal Information to Firms. 

7. The matching process

7.1 We may match Your legal problem with Firms based on, but not limited to the following criteria: geographical locations, practice areas and language skills.

7.2 We are in no way liable, directly or indirectly, in equity or in law, for any loss or damage arising from or in connection with the Firm You choose as the Winning Firm.

7.3 We do not hold out, represent or guarantee that any Firm will Bid for your matter posted on the Website.  In the event that no Firm Bids for Your matter, that is in no way a representation by Us about the chances of success of Your case, or otherwise, about Your case.

7A. Bid is not an offer

7A.1 You acknowledge that any Bid you receive from a Firm on the Website is not an "offer" from that Firm.  You understand that Firms will provide You with an estimate of fees only.  Firms have agreed with Us to base those estimates on the information You have provided on the Website.  You understand that those estimates are not binding and are an "expression of interest" only.

7B. Choosing a Winning Firm to meet with

7B.1 You agree to choose (on the Website) the law firm (if any) you would like to meet with to discuss your legal issue.  You agree not to bypass Us and meet with any law firm who has Bid for your matter without first choosing that law firm as the Winning Firm on the Website.

7B.2 If you select a Winning Firm (ie, the one you would like to meet with) and then decide not to meet with that law firm, You agree to contact Us immediately.

7B.3 You understand that the Winning Firm will pay to Us the Referral Fee in exchange for the opportunity to meet with you to discuss your legal issue.

7B.4 You agree to only choose a Winning Firm if you genuinely intend to meet with that law firm.

7B.5 If you want to meet with more than one law firm that has Bid for your case, you agree to contact Us.  In that event, each law firm will pay the Referral Fee for the opportunity to meet with you.

7B.6 You acknowledge that choosing a Winning Firm on the Website does not constitute "acceptance" and does not mean you have entered into a binding contract. Further, you agree that it does not constitute an instruction to the Winning Firm and therefore a full cost disclosure (per each States Legal Profession Act/Regulations) is not required.


8. No representation or guarantee about Firm

8.1 We make reasonable efforts to confirm that Firms are licensed to practice in the relevant State.  Whilst we make those reasonable efforts, You understand that You bear the onus of verifying that a Firm is licensed to practice in a relevant State.  You agree not to rely on the fact that a Firm is a member of Select Law to prove (or go to prove) that the Firm is licensed to practice in the relevant State.

8.3 We do not represent, hold out or guarantee that:

a) Firms are licensed or legally permitted to give legal advice or the services they purport to offer on the Website;

b) a Firm is who it claims to be;

c) any description of the services offered by Firms or other information provided by a Firm is accurate;

d) any bid made by a Firm is accurate, realistic or made in good faith; or

e) Firms are competent or of a certain quality or ability.

8.4 We do not provide advice about any Firm, or assist in, influence or seek to influence, Your selection of the Winning Firm.

8.5 You acknowledge that You are solely responsible for choosing a Winning Firm.

8.6 We do not guarantee, warrant or represent that the Firm You select will be suited to Your needs, that the Winning Firm will charge the amount set out in its Tender or that You will be happy with the Winning Firm's service.

9. Winning Firm will contact You

9.1 The Winning Firm has agreed (with Us) to contact You within one day of You choosing that Firm as the Winning Firm to arrange a meeting time.  You are also free to contact the Winning Firm yourself to arrange a meeting time.

9.2 The Winning Firm has agreed (with Us) to advise You, at the start of the initial phone call, if it intends to charge (and if so, at what rate) for that phone call. 

9.3 If the Winning Firm does not contact You within that time frame, You agree to contact Us and not the Winning Firm.

10. You are not bound to retain services of Firm

10.1 Your use of the Website, and in particular the choosing of a Winning Firm, does not create any legal or equitable relationship between You and the Firm.

10.2 You are not bound, by reason of selecting a Winning Firm, to engage the services of that Winning Firm.  You must only, however, choose a Winning Firm if you genuinely intend to meet with that law firm to discuss your legal issue.


Firm terms and conditions


1. Definitions

1.1“Select Law” used in these terms and conditions, and throughout the Website, means Select Law Pty Ltd (ACN 124 185 119) and may be referred to interchangeably as, “We” “Us” and “Our" as appropriate.  It also includes our employees, agents and servants.

1.2 “Firm” refers to law firms, incorporated practices or sole practitioners who are members of Select Law.

1.3 “User” refers to those members of the general public (including companies and in-house counsel) utilizing this website in order to find a Firm or otherwise.

1.4A “In-house Legal Matter” means a case posted by an in-house corporate lawyer on behalf of the company that they work for.

1.4B “Standard Matter” means all cases posted by Users, other than those set out in clause 1.5A.

1.4C “In-house Legal Referral Fee” means the referral fee payable by the Winning Firm for a In-house Legal Matter.  That fee is set, for the meantime, at $150 (including GST).

1.4D “Standard Referral Fee” means the referral fee payable by the Winning Firm for a Standard Matter.  That fee is set, for the meantime, at $55 (including GST).

1.5 “Referral Fee” means either In-house Legal Referral Fee or the Standard Referral Fee, whichever is relevant.

1.6 “Website” means this website, ie, www.legaltender.com.au.

1.7 “You” and “Your” refer to You, the Firm.

1.8 “Bid", "Tender", "Quotation" and “Quote” are used interchangeably in these Firm Terms and Conditions, and throughout the rest of the Website, to mean an estimate of legal fees, charge out rate given by a Firm, and/or any quotation notes.

1.9 “Firm information” means includes any information posted by a Firm on the Website.

1.10 The use of the singular in these Firm Terms and Conditions and throughout the Website includes, where appropriate, a reference to the plural.

1.11 “Winning Firm” means the Firm a User chooses as the law firm he/she/it intends to meet with to discuss their legal issue.

2. Application

2.1 These Firm Terms and Conditions apply to Firms.

3. Acknowledgement and acceptance of Terms and conditions

3.1 By accessing, browsing or using the Website You impliedly acknowledge that You have read and understood these Firm Terms and Conditions and agree to be bound by them.

3.2 By completing the registration process to become a Firm You expressly agree to be bound by these Firm  Terms and Conditions. 

4. Amendments to Terms and Conditions

4.1 We may amend these Firm Terms and Conditions at our discretion, and from time to time and without notice.

4.2 Your continued use of the Website after any amendment to the Firm Terms and Conditions, is taken to constitute Your acceptance of those amended Firm Terms and Conditions and to be bound by them.  It is Your responsibility to check these Firm Terms and Conditions each time You use the Website.

4A. Warranty about current practicing certificates

4A.1 By registering with Select Law, remaining a Firm or continuing to use the Website, you expressly warrant and guarantee that all partners and/or principals of Your Firm hold a current practicing certificates pursuant to the relevant Legal Profession Act in Your State. 

4A.2 Upon request, You agree to provide to Us a certified copy of the current practicing certificates of the partners and/or principals of Your Firm.

4A.3 You agree to notify Us in writing in the event that any partner or principal of Your Firm has had, or is at risk of having, their current practicing certificate varied, revoked or not renewed.  You agree to notify Us within 2 business days of that event occurring.

4A.3 You agree to notify Us in writing of any event which may render any partner or principal of Your Firm "unfit" to act as a lawyer in that State under the relevant Law. You agree to notify Us within 2 business days of that act occurring.

5. Our use of Your Information

5.1 Our obligations in relation to Our use of Firm information is set out in our Privacy Policy, which can be accessed from the homepage of the Website.

5.2 You understand and accept that each time You tender for a User’s matter, that User will be able to view Your Firm Information.

5.3 You understand that we can publish and make publicly available the fact that You have registered with Select Law.  This may include, but is not limited to, advertisements, articles online and in hardcopy, on the Website and to other Firms.

6A. Invitations to tender

6A.1 We may invite Firms to tender for either Standard Matters or In-House Legal Matters.

6A.2 We automatically invite Firms to tender for matters based on location, pracitce areas and language skills.

6A.3 We reserve the right to manually invite other Firms to tender for a matter.

6A.4 You agree not to hold Us liable in law or equity for any damage or loss that You or a related party may suffer if You were not automatically invited to tender for a matter when you should have been, or if You feel We should have manually invited Your Firm to tender for a matter.

6. You agree to keep User Information confidential

6.1 You agree to keep confidential all User Information that You are privy to.  This includes, but is not limited to, the fact that a User has posted information on our site, the other parties to the matter, the type of matter and all further details provided by the User.

6.2 You expressly understand and agree that You owe a duty of confidence to Users in relation to the User Information, to which you have been privy.

6.3 You expressly understand and agree that you owe a duty of confidence to Us in relation to any User Information to which you have been privy.

6.4 For the avoidance of doubt, you agree not to disclose any User Information, to which You have been privy, to any third party.  You expressly agree not to act for any future client, if, by agreeing to act for that future client, You would be required to disclose any Users' Information.  In that event, You expressly agree not to act for that future client.


7. No representation or guarantee about User

7.1 We do not verify information posted on the Website by Users.

7.2 Firms bear the onus of verifying all User Information.

7.3 We do not represent, hold out or guarantee that a User is whom he/she/it claims to be or that any User Information is accurate, current or legitimately posted.

7.4 We do not guarantee, warrant or represent that, the User will engage the Winning Firm for its services.

7.5 Notwithstanding the above, We contact each User that has posted a case, to confirm that their contact phone number is valid.  We also seek to confirm, to a reasonable level, that the User is genuinely seeking legal advice and that they are not unemployed, on a low income or receiving government benefits .

7A. Bid is not an offer

7A.1 You acknowledge that any Bid you provide to a User on the Website is not an "offer" to that User.  It is not binding and is more of an "expression of interest".

7B. Choosing Winning Firm is not acceptance

7B.1 You acknowledge that a User choosing You as the Winning Firm does not constitute "acceptance", and is not a "instruction" to the Winning Firm. 

7B.2 You acknowledge that a User choosing You as the Winning Firm means only that the User wishes to meet with your law firm to discuss their legal issue. 

8. Quotations are not binding but must be reasonable

8.1 You agree to provide to the User, through the Website, reasonable (and realistic) quotations based on the information that the User has provided.

8.2 Quotations given by Firms through the Website are not binding.  For the avoidance of doubt, they do not constitute an "offer".

8.3 In the event that, in Our opinion, You are not providing realistic or reasonable Tenders, we reserve the right to de-activate and/or delete Your account with Us. 

8.4 You consent to Us contacting you by phone, email or otherwise to discuss any tender you have given on the Website.

8A. Substance of Quotations

8A.1 You agree not to include contact details (including, but not limited to email, phone, address or fax) in any Bid that you provide on the Website.  In the event that You do provide those contact details, You understand that We reserve the right to delete them from Your Quotation.

8A.2 You agree not to suggest to a User in Your Bid that the User may not need legal advice, or that they may be able to obtain free advice from a Community Legal Centre or similar body.  In the event that You think that to be true, you agree to contact Us to discuss the matter.

8A.3 You consent to Us amending Your Bid to correct formatting issues, typographical errors or grammatical corrections.

9. You may not receive an invitation to tender

9.1 We do not guarantee that a Firm will receive an invitation to Tender for a User’s matter.

9.2 We do not guarantee that use of the service by a Firm will result in a User engaging Your Firm for services.

10. Referral Fee

10.1 If You win a Standard Matter, You agree to pay to Select Law the Standard Matter Referral Fee by way of credit card over the Website.

10.2 If You win an In-House Legal Matter, You agree to pay to Select Law the In-house Legal Referral Fee by way of credit card over the Website.

10.3 You agree to make that payment (of the Referral Fee) within 1 business day of notification that You are the Winning Firm for that matter.

10.4 The Referral Fee is not refundable.  In the event that the User selects Your Firm as the Winning Firm, however, does not meet with your law firm to discuss that legal issue, You agree to contact Us to discuss the matter.  In that event, we may, in our discretion, apply a credit to your account for that Referral Fee.

10.5 We reserve the right to change the amount of the Referral Fee at any time after notification of such a change is given to Firms by email or otherwise.

 

11A. When the Referral Fee is payable and consideration for Referral Fee

11A.1 The consideration for the Referral Fee is the opportunity to meet with the client.  If the client chooses only one law firm as the Winning Firm then the Referral Fee must be paid by that firm in accordance with clause 10

11A.2 If the client chooses more than one law firm as the Winning Firm, then each Winning Firm must pay the Referral Fee to Us in accordance with clause 10.

11A.3 If the User by-passes the Select Law Website, and meets with your firm in relation to their legal issue, without selecting your firm as the Winning Firm Your Firm will be deemed to be the Winning Firm.  

11A.4 You agree not to pass on the Referral Fee to the User. 


11. User’s that bypass Select Law

11.1 If a User by-passes the Select Law Website, and meets with your firm in relation to their legal issue, without selecting your firm as the Winning Firm Your Firm, you agree to immediately contact Select Law.

11.2 In the event that You do not comply with this section, we reserve the right to:

a) bar You from using the Website or any of the services provided by Select Law;

b) destroy, delete or store elsewhere any data or content submitted by You on the Website; and

c) commence legal proceedings against you to recover the monies owed to Us and any costs incurred in doing so on an indemnity basis.

12. Winning Firm agrees to contact User

12.1 You agree to contact Users within 1 business day of being notified by Select Law that You are the Winning Firm.   If the User has already contacted you by that time, you do not have to contact that User yourself.

12.1 The Winning Firm must advise the User, at the start of any telephone contact (before the initial meeting), if it intends to charge the User (and if so, at what rate) for that telephone call. 


13. Conflict searches

13.1 Before you access a User’s case details, You agree to conduct a conflict search based on that User’s full name, type of dispute and other parties involved in the dispute (as posted by the User). We will provide that information to you, before a User’s case details are visible.  You agree not to open a User's case details if you have, or may have, a potential conflict of interest with that User or that User's matter.

13.2 It is Your responsibility to conduct conflict searches, and We are in no way liable, in law or in equity, directly or indirectly, for:

a) any loss or damage that may result from a conflict;

b) any incorrect information posted by a User that the Firm has relied on in conducting its conflict search; or

c) any restrictions that You may face in relation to taking on future clients, by reason of Your exposure to User Information.

13.3 Notwithstanding the paragraph above, You agree to indemnify Us for any liability that We may incur in relation to conflict searches You conduct or do not conduct.

14. State regulation

14.1 You agree that all matters in relation to Your compliance with each States' Legal Profession Act, Regulation, Rules and Profession Code of Conduct is a matter for You, and not Us.  You agree to attend to all matters in relation to your compliance with the Act. 

14.2 You agree that any failure by You to comply with the Act which may lead to You not being paid by a User for your services in no way relieves You of Your obligation to pay the Referral Fee. 

14.3 You agree that We are not liable either directly or indirectly, in law or in equity, for any damage or loss suffered by or in connection with Your failure to comply with the Act.  You agree not to threaten to or commence any proceedings against Us in that regard.
